SUMMARY
The Spanish pharmaceutical market is the fifth largest in the EU-15 and the

In June 2006, Spain approved a new pharmaceutical law, Ley de Garantias y Uso
Racional de los Medicamentos y Productos Sanitarios (Ley 29/2006). The new law
has been effective since July 2006 and replaces the previous pharmaceutical
law, Ley de Medicamentos (Ley 25/1990), issued in 1990. The new law
incorporates Directive 2004/27/EC for human pharmaceuticals and Directive
2004/28/EC for veterinary pharmaceuticals. Also, it harmonises the national
regulation with Europe, under Regulation 2004/726/EC.
Under the new pharmaceutical law, the government has started to work on the
regulatory framework for the new Reference Price System (RPS), to be
operational on 1st March 2007. The new RPS aims to be more transparent and
will promote generics. The previous RPS, introduced by the conservative party
in January 2004, was suspended in 2005. As an alternative, the government
introduced drug price cuts and reduced wholesalers' margins in March 2005 and
2006, in an effort to sustain the SNS system.
The Spanish pharmaceutical market is the fifth largest in the EU-25, valued at
US$21.0 billion in 2006. The pharmacy sector represented 76.9% of the market
at manufacturers' prices in 2005. Almirall Prodesfarma and Esteve are the
leading domestic producers, with sales valued at US$1.2 billion and US$1.0
billion, respectively, in 2005. Their annual R&D investment has risen sharply
in recent years. In fact, Almirall opened a new state-of-the-art R&D centre in
Barcelona in May 2006, with investments valued at US$151 million. Esteve
continues to enhance its market presence in China, with a second joint-venture
established with Huadong's Yiwu Huayi in January 2006.
The generics sector continues to grow, and currently represents 11.6% of the
pharmacy sector by volume. One of the latest companies to invest in the sector
is the Indian Wanbury Ltd, which announced the acquisition of Cantabria
Farmaceutica's branded generic medicines in October 2006. The trade
association AESEG represents 24 generic producers which account for 80.0% of
the sector. As 15 leading new active ingredients will lose their patents in
the next years, further opportunities will arise for the sector.
